Commercial Terms of Service

All products offered by FuelX Peptides are sold strictly and exclusively for legitimate in-vitro laboratory research, analytical testing, chemical analysis, biochemical research, enzymatic evaluation, cell-culture research, and other lawful non-clinical laboratory applications. Unless expressly stated otherwise, FuelX Peptides products have not been approved, cleared, or authorized by the United States Food and Drug Administration (FDA) for use as drugs, biologics, medical devices, dietary supplements, foods, cosmetics, or veterinary products. FuelX Peptides products are not offered, represented, marketed, labeled, or sold for human or veterinary use. Products must not be used for diagnosis, treatment, mitigation, cure, or prevention of disease or for alteration of the structure or function of a human or animal body.

Buyer represents, warrants, and agrees that FuelX Peptides products will not be:

• consumed, ingested, injected, inhaled, implanted, absorbed, topically applied, or otherwise administered to any human;
• administered to or used in any animal, including laboratory animals — products may not be administered to or used in any human or animal;
• used for self-experimentation, clinical trials, patient treatment, diagnosis, therapy, cosmetic procedures, bodybuilding, weight management, anti-aging, performance enhancement, or veterinary treatment;
• compounded, formulated, prepared, or reconstituted for human or veterinary administration;
• incorporated into a product intended for human or animal consumption or administration; or
• otherwise introduced into a living organism.

Any such use is unauthorized. Unless a specific written specification states otherwise for a lawful research purpose, FuelX Peptides does not represent that products are sterile, pyrogen-free, endotoxin-free, clinically safe, therapeutically effective, suitable for injection, or appropriate for administration to a living organism.

Buyer represents and warrants that Buyer is at least twenty-one (21) years old and legally capable of contracting; purchases solely for legitimate and lawful research; possesses, or acts under supervision possessing, sufficient scientific knowledge, training, facilities, protocols, and safety equipment; understands potential hazards; will use appropriate laboratory procedures; will comply with applicable laws; and is not purchasing for any prohibited human, veterinary, clinical, diagnostic, therapeutic, cosmetic, compounding, or in-vivo purpose. A person buying for an organization represents that the person has authority to make the purchase and, where applicable, bind that organization.

FuelX Peptides may request information reasonably necessary to evaluate whether a purchaser or transaction is consistent with these research-use restrictions, including research affiliation, laboratory or institutional information, intended research category, business information, or related documentation. FuelX Peptides has no obligation to approve any purchaser or transaction.

To the extent permitted by law, FuelX Peptides may refuse, restrict, suspend, or cancel an account, transaction, or order when it reasonably believes the purchaser is ineligible; a product may be used for a prohibited purpose; prohibited-use guidance has been requested; these Terms were violated; unauthorized resale, transfer, distribution, relabeling, or repurposing is intended; a legal, regulatory, fraud, safety, payment, sanctions, export-control, or compliance concern exists; or fulfillment would create unreasonable legal or regulatory risk. Refunds will be handled under applicable FuelX Peptides policies and law.

Buyer may not knowingly sell, provide, distribute, transfer, relabel, repackage, or make a FuelX Peptides product available for a prohibited purpose; remove, obscure, alter, or misrepresent research-use warnings or labeling; represent a product as approved, suitable, sterile, safe, or effective for human or veterinary administration; or transfer a product when Buyer knows or reasonably should know that the recipient intends a prohibited use.

Nothing on the FuelX Peptides website, product pages, Certificates of Analysis, research materials, communications, educational materials, scientific references, or other content is medical, clinical, veterinary, pharmaceutical, diagnostic, therapeutic, or patient-specific advice. FuelX Peptides does not provide dosing recommendations, treatment protocols, injection instructions, clinical cycles, therapeutic regimens, diagnoses, or administration recommendations. Scientific references and research findings are provided solely for legitimate scientific and research purposes.

FuelX Peptides personnel are not authorized to advise on human or veterinary administration, dosing, injection, clinical treatment, therapeutic outcomes, side effects, treatment cycles, or preparation for administration. If a communication reasonably indicates prohibited use or intent, FuelX Peptides may decline related information, suspend or terminate the account, or cancel pending transactions as permitted by law. Nothing here restricts honest reviews, safety reports, communications with authorities, protected rights, or communications protected by law.

Buyer is solely responsible for determining whether purchase, possession, importation, exportation, transportation, research use, storage, and disposal are lawful in Buyer's jurisdiction. Product availability is not a representation of legality in every jurisdiction. Buyer will comply with all applicable laws, regulations, institutional rules, laboratory requirements, trade controls, and sanctions.

Buyer is responsible for appropriate laboratory safety procedures. Products must be stored, handled, secured, transported, and disposed of according to applicable product documentation, laboratory standards, Safety Data Sheets where applicable, institutional requirements, and law. Buyer must prevent unauthorized access, including by children, patients, consumers, animals, or untrained persons.

A Certificate of Analysis (COA), analytical report, specification, purity result, or similar documentation pertains only to the identified sample, batch, methodology, and parameters. It does not establish sterility, clinical safety, therapeutic effectiveness, injectability, consumability, or suitability for human or veterinary use. Analytical purity is not evidence of safety or suitability for administration to a living organism.

Buyer acknowledges that research compounds may involve known and unknown chemical, biological, toxicological, environmental, storage, handling, and experimental risks and voluntarily assumes risks ordinarily associated with lawful possession, handling, storage, transportation, testing, and use, to the maximum extent permitted by law. Nothing transfers responsibility that applicable law does not permit FuelX Peptides to disclaim, waive, or transfer.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRODUCTS ARE PROVIDED AS IS AND WITH ALL FAULTS, SUBJECT TO EXPRESS WRITTEN PRODUCT SPECIFICATIONS. EXCEPT FOR WARRANTIES THAT CANNOT LAWFULLY BE DISCLAIMED, FUELX PEPTIDES DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FUELX PEPTIDES MAKES NO WARRANTY OF SUITABILITY FOR HUMAN, VETERINARY, CLINICAL, THERAPEUTIC, DIAGNOSTIC, OR OTHER PROHIBITED USE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUELX PEPTIDES AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, REVENUE, DATA, BUSINESS INTERRUPTION, OR BUSINESS OPPORTUNITY, ARISING FROM A PRODUCT OR TRANSACTION. FUELX PEPTIDES'S AGGREGATE LIABILITY ARISING FROM A PARTICULAR PRODUCT OR TRANSACTION WILL NOT EXCEED THE AMOUNT ACTUALLY PAID FOR THAT PRODUCT. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

Buyer acknowledges that human, veterinary, clinical, therapeutic, and other prohibited use is outside the intended and authorized purpose of FuelX Peptides products. To the maximum extent permitted by law, Buyer assumes responsibility for losses, injuries, claims, or damages resulting from Buyer's intentional, negligent, unauthorized, or unlawful use in violation of these Terms. Nothing waives non-waivable liability or limits a right or remedy that law prohibits FuelX Peptides from limiting.

To the maximum extent permitted by law, Buyer agrees to indemnify, defend, and hold harmless FuelX Peptides and its owners, affiliates, officers, directors, employees, agents, contractors, and representatives from third-party claims, liabilities, damages, judgments, penalties, losses, and reasonable attorneys' fees and costs arising from Buyer's unauthorized or unlawful use; violation of these Terms or law; unauthorized resale, distribution, transfer, relabeling, or repackaging; provision to another person for a prohibited purpose; or injury or damage caused by improper storage, handling, transportation, disposal, or unauthorized administration. FuelX Peptides may participate in the defense. No settlement imposing liability, admission, or obligation on FuelX Peptides may be entered without written consent.

All orders are subject to FuelX Peptides acceptance. An order confirmation is not irrevocable acceptance. FuelX Peptides may reject or cancel for availability, pricing or listing error, suspected fraud, payment issue, regulatory or purchaser-eligibility concern, suspected prohibited use, shipping or export restriction, or other legitimate business or compliance reason. Any refund due will be processed under applicable FuelX Peptides policies and law.

Buyer must provide accurate shipping information and ensure legal eligibility to receive ordered products. International purchasers are responsible for import requirements, customs, duties, taxes, permits, and restrictions. Shipping, delivery, title, and risk of loss are subject to applicable law and FuelX Peptides's posted Shipping and Returns Policy.

Returns, replacements, refunds, damaged shipments, missing products, and quality concerns are governed by FuelX Peptides's posted Shipping and Returns Policy. Nothing in that policy or these Terms limits rights that cannot lawfully be waived.

Scientific information on the FuelX Peptides website is for general laboratory research and informational purposes. Literature may describe independent research; references do not endorse human use or represent that results will occur outside stated experimental conditions. Buyer must independently evaluate scientific information and determine lawful experimental methodology.

Unless otherwise stated, FuelX Peptides website design, trademarks, logos, graphics, photographs, product presentation, original text, and other proprietary content are owned by or licensed to FuelX Peptides and protected by applicable law. No license to use FuelX Peptides trademarks or proprietary materials is granted except by express written authorization.

This Section summarizes the privacy terms that form part of this agreement. It is consistent with, and incorporates by reference, the FuelX Peptides Privacy Policy. Where this Section and the Privacy Policy address the same subject, the Privacy Policy governs the description of our data practices and the Privacy Policy's stated rights and request procedures control.

22.1 Information processed. In connection with an account, application, order, or inquiry, FuelX Peptides processes: identifiers and contact information (name, email, telephone, organization, billing and shipping addresses); account and authentication information, including hashed credentials, session tokens, approval status, and role; researcher application information, including research context, anticipated order volume, acknowledgments, electronic signature, and signature date; order, invoice, and transaction information; payment-related information limited to the confirmation you upload, the payment reference or memo, and the fact and date of payment; shipping and logistics information, including address, package details, rate quotes, and tracking numbers; communications with us; device, browser, and technical information, including IP address and log data; and fraud-prevention and compliance information. FuelX Peptides does not knowingly process sensitive personal information, biometric data, precise geolocation, health records, or information from anyone under twenty-one (21) years of age.

22.2 Payment information. Payment is completed manually via Zelle. FuelX Peptides does not collect, receive, or store card numbers, bank account numbers, or banking credentials, which remain with Buyer's own bank or payment application. Buyer is responsible for the accuracy of the payment confirmation Buyer uploads and for not including unnecessary personal or financial information in it.

22.3 Purposes of processing. Information is processed to review researcher applications; to create, authenticate, and administer accounts and to control access to pricing and ordering; to quote shipping for, invoice, fulfill, and ship orders and to confirm receipt of payment; to provide support; to send transactional communications; to secure the website and prevent fraud and abuse; to enforce these Terms and the Research Use Only Policy; to comply with legal, tax, regulatory, and recordkeeping obligations and respond to lawful process; and to maintain and improve website reliability in aggregate.

22.4 No sale of personal information and no targeted advertising. FuelX Peptides does not sell personal information, does not share personal information for cross-context behavioral or targeted advertising, does not use advertising or cross-site tracking cookies, and does not conduct profiling in furtherance of decisions producing legal or similarly significant effects. Researcher application decisions are reviewed by a person.

22.5 Categories of recipients. Information is disclosed only as needed to hosting, database, authentication, and file-storage providers; email delivery providers; shipping and logistics carriers; professional advisors such as accountants, auditors, and legal counsel; government authorities, regulators, and law enforcement where required by law or lawful process; and a successor entity in connection with a merger, acquisition, financing, reorganization, or asset sale, subject to the Privacy Policy. Service providers are authorized to use information only to provide services to FuelX Peptides.

22.6 Cookies and similar technologies. The website uses strictly necessary cookies and browser local storage to maintain sign-in and session state, cart contents, and the age-verification acknowledgment, and to protect against abuse. Disabling these technologies may prevent sign-in and ordering from functioning.

22.7 Retention. Records are retained only as long as needed for the purpose collected and to meet legal obligations: account and application records for the life of the account and thereafter as needed to document eligibility determinations and defend claims; order, invoice, and tax records for the period required by applicable tax, accounting, and commercial recordkeeping law; payment confirmations for the period needed to reconcile payment and resolve disputes; support correspondence for as long as needed to resolve the matter; and security, server, and diagnostic logs for a limited period consistent with security monitoring. Information no longer needed is deleted or de-identified.

22.8 Security. FuelX Peptides maintains administrative, technical, and organizational safeguards appropriate to the sensitivity of the information, including encrypted transmission, encryption of stored data by its managed platform, hashed authentication credentials, row-level access controls restricting records to the account that owns them, private storage for uploaded payment confirmations accessible only through time-limited authorized links, and restriction of administrative access to authorized personnel. No method of transmission or storage is completely secure, and absolute security cannot be guaranteed. Buyer is responsible for safeguarding Buyer's account credentials and for all activity occurring under Buyer's account, and must notify FuelX Peptides promptly of any suspected unauthorized access.

22.9 Privacy rights and requests. Depending on state of residence, Buyer may have the right to confirm processing and access information, obtain a portable copy of information provided, correct inaccuracies, delete information subject to legal, tax, safety, and recordkeeping exceptions, opt out of the sale of personal information, targeted advertising, and certain profiling — activities FuelX Peptides does not conduct — and to be free from discrimination or retaliation for exercising these rights. Requests are submitted to info@fuelxpeptides.com with the subject line "Privacy Request" and are verified against the information associated with the account. An authorized agent may submit a request with written, signed authorization.

22.10 Florida residents. Residents of Florida have the rights described in the Florida Digital Bill of Rights notice set out in the Privacy Policy, including the right to submit a request using the subject line "Florida Privacy Request," to receive a response without undue delay and within forty-five (45) days of receipt, subject to one fifteen (15) day extension where reasonably necessary, and to appeal a denial using the subject line "Florida Privacy Appeal," with a written decision within sixty (60) days and instructions for contacting the Florida Department of Legal Affairs.

22.11 Electronic communications and consent. By creating an account, submitting an application, placing an order, or communicating with FuelX Peptides electronically, Buyer consents to receive transactional communications electronically, including application decisions, invoices, order confirmations, shipping notices, and account and security messages, sent to the address associated with the account. These messages are part of the service and are not marketing. Non-transactional email or SMS is sent only with consent and includes an opt-out method in each message; message and data rates may apply to SMS. Buyer consents to the use of electronic records and electronic signatures, including the electronic signature captured on the researcher application, and agrees that they have the same legal effect as handwritten signatures.

22.12 Location of processing. FuelX Peptides operates in the United States and its service providers process information in the United States. Buyer accessing the website from outside the United States understands that information will be transferred to and processed in the United States.

22.13 Changes. The Privacy Policy may be updated to reflect changes in practices, technology, or legal requirements, and the "Last updated" date on that policy indicates when the current version took effect. Continued use of the website after posting constitutes acceptance of the revised Privacy Policy.

Buyer may not purchase, export, re-export, transfer, or provide products in violation of United States export controls, economic sanctions, trade restrictions, or applicable international trade laws and represents that Buyer is not prohibited from the transaction.

FuelX Peptides is not liable for delay or failure caused by circumstances beyond reasonable control, including natural disasters, severe weather, carrier interruption, supply-chain disruption, labor dispute, governmental action, regulatory change, war, terrorism, civil unrest, epidemic, pandemic, power failure, or telecommunications failure.

These Terms are governed by Florida law, without regard to conflict-of-law principles, except where federal or other applicable law controls. Subject to legally required alternative venue, judicial proceedings shall be brought exclusively in the state or federal courts located in Broward County, Florida, and the parties consent to the personal jurisdiction and venue of those courts.

If a provision is invalid, unlawful, or unenforceable, it will be enforced to the maximum lawful extent or severed to the minimum necessary extent, and the remaining provisions remain effective.

FuelX Peptides's failure to enforce a provision on one occasion does not waive future enforcement of that or any other provision.

Buyer may not assign or transfer rights or obligations without FuelX Peptides's prior written consent. FuelX Peptides may assign these Terms in a merger, acquisition, restructuring, asset sale, or other lawful business transaction, subject to law.

These Terms and expressly incorporated policies constitute the agreement between FuelX Peptides and Buyer concerning purchase and permitted use of FuelX Peptides research products, except where a separate written agreement signed by FuelX Peptides expressly provides otherwise.

FuelX Peptides may modify these Terms as permitted by law. The version presented to and accepted by Buyer at the time of a transaction generally applies to that transaction unless law requires otherwise. Material changes will not be applied retroactively where prohibited.

Provisions that by their nature should survive termination, including prohibited-use, intellectual-property, liability-limitation, indemnification, governing-law, and accrued-obligation provisions, survive account termination or transaction completion.

Before purchase, Buyer affirmatively certifies:

• I am at least 21 years old and legally authorized to make this purchase.
• I am purchasing solely for legitimate laboratory research.
• I understand FuelX Peptides products are not sold for human or veterinary use.
• I will not ingest, inject, inhale, topically apply, administer, or otherwise introduce these products into a human or animal.
• I will not use or provide products for clinical, diagnostic, therapeutic, cosmetic, compounding, bodybuilding, weight-management, anti-aging, or other prohibited purposes.
• I will not resell or transfer products when I know or reasonably should know they will be used for a prohibited purpose.
• I have the knowledge, facilities, procedures, and equipment necessary to safely handle these research materials.
• I have reviewed and agree to the FuelX Peptides Commercial Terms of Service and applicable policies.
